Coatzacoalcos, Ver., 18 de enero de 2017.- El presidente de la Barra de Abogados de Coatzacoalcos, Homero Gutiérrez Melchor apuntó que los primeros en estar implicados en la aplicación de medicamentos falsos a niños con cáncer en Veracruz son los médicos y enfermeras que los trataron, este señalamiento es de acuerdo a lo que establece el Código Penal Federal.
Dijo que se podrán fincar responsabilidades contra los involucrados de existir un antecedente, en el que los especialistas dieron a conocer tal situación a sus superiores y estos finalmente fueron los que decidieron no hacer nada al respecto.
“La responsabilidad primaria le recae sobre el médico tratante porque él fue el que siguió una orden superior de aplicar un tratamiento, él es el responsable directo, los auxiliares también y estos a su vez debieron comunicar a sus superiores al Director del Nosocomio y el al Secretario de Salud, si esta cadena de información se finco entonces se podrán deslindar responsabilidades.”
Aseveró que la pena para aquellos que se hayan visto inmiscuidos en este atentado a los menores con cáncer, es de apenas seis años de prisión que consideró es mínima para el delito que se estaría cometiendo.
Dijo que si al entonces mandatario estatal y a los ex secretarios de salud se le comunicó que los galenos aplicaron estas pruebas médicas sabiendo que se trataba a los menores con quimioterapias falsas, comenzarían a deslindarse las responsabilidades.
“El hecho si ellos se hubieran negado a llevar estas prácticas médicas que son de todos vistas ilícitas, creo que entonces podremos decir que se puede construir una imputación una acusación a todos los entes que participaron, hay que poner mucha atención en ello.”
El delito se le conoce como de “médicos y tratantes médicos” así es como es contemplado en el Código Penal, pero también pueden integrarse otros delitos como la omisión al auxilio, inducción al suicidio y de responsabilidad administrativa.
