Redacción) 15 de febrero de 2017.- El pleno del Instituto de Transparencia, Acceso a la Información y Protección de Datos Personales emitió los lineamientos para calificar la gravedad de los incumplimientos de sujetos obligados en materia de transparencia para imponer las notificaciones y medidas de apremio, que van desde las amonestaciones hasta las multas, como medida para garantizar el cumplimiento de la Ley Federal de Transparencia y Acceso a la Información Pública.
Será la Secretaría Técnica del Pleno el área encargada de calificar las faltas, cuando los sujetos obligados persistan en el incumplimiento de sus obligaciones de transparencia. Dicha calificación tomará en cuenta la dimensión del perjuicio ocasionado en términos de los derechos constitucionales previstos en el artículo 6º, la Ley General y la Ley Federal, los indicios de intencionalidad del incumplimiento, la duración del incumplimiento y la reincidencia. Cuando proceda se podrá requerir al infractor, a las instituciones competentes y a las instituciones financieras para determinar la condición económica del infractor aunque también se acudirá a información pública. Estas nuevas disposiciones entran en vigor el 16 de febrero, un día después de publicadas en el Diario Oficial de la Federación.
