La Sala Superior del Tribunal Electoral del Poder Judicial de la Federación (TEPJF) ordenó al Organismo Público Local Electoral (OPLE) Veracruz emitir un nuevo acuerdo que incluya en el otorgamiento de financiamiento público a los partidos políticos nacionales que participaron en el proceso electoral inmediato anterior que no obtuvieron el 3% de la votación valida emitida y no han perdido su registro como partidos nacionales.
Al resolver el SUP-JRC-3/2017 y acumulados, promovidos por los partidos Encuentro Social, Nueva Alianza, Partido del Trabajo y Movimiento Ciudadano, el Pleno determinó revocar las sentencias del Tribunal Electoral de Veracruz, que confirmó el acuerdo OPLEV/CG282/2016 del Consejo General del OPLE, por el que se ajustó el proyecto de presupuesto para el ejercicio fiscal 2017.
Además, aprobó interrumpir la Jurisprudencia 10/2000, con el rubro “Financiamiento público local. El derecho a recibirlo es diferente para los partidos políticos participantes en una elección anterior que no demostraron cierta fuerza electoral respecto a los de reciente creación”, y dejarla sin efecto, a fin de evitar condiciones de inequidad.
Por mayoría de votos, el Pleno consideró que para preservar el principio de equidad, los partidos políticos nacionales que no obtuvieron el 3% de la votación válida emitida y participen en las subsecuentes elecciones estatales, reciban financiamiento público para gastos de campaña, como si se tratara de partidos que obtuvieron su registro con fecha posterior a la última elección de diputados locales, en términos de lo previsto en el artículo 50, apartados B y D del Código Electoral del Estado de Veracruz.
La Sala Superior ponderó la posibilidad de que exista inequidad en la contienda electoral, así como vulneración en los principios de igualdad de oportunidades en la competencia y prevalencia del financiamiento público sobre el privado, al imposibilitarlos a recibir este último, lo que colocaría a los partidos en una situación de desventaja respeto de los demás institutos políticos que participan en el referido proceso electoral estatal.
