Xalapa, Ver., 19 de enero de 2017.- La coordinadora del grupo legislativo del Partido de la Revolución Democrática en el Congreso del Estado, Jazmín de los Ángeles Copete Zapot, presentó una reforma a la Constitución Política de Veracruz para que ya no sea facultad del titular del Poder Ejecutivo el nombramiento de los magistrados del Tribunal Superior de Justicia.
De esta forma el Congreso emitirá una convocatoria pública y previo al cumplimiento de requisitos de elegibilidad de los aspirantes aplicará un examen de oposición para integrar tres ternas que remitirá al titular del Poder Ejecutivo a efecto de que previo análisis de los perfiles y puntajes obtenidos retorne al Congreso una terna para elegir al magistrado respectivo mediante mayoría calificada.
El presidente será elegido por el pleno del Tribunal Superior de Justicia de entre todos los magistrados que integran el Poder Judicial cada tres años en la primera semana de diciembre en los términos que establezca la ley.
El magistrado presidente podrá ser reelegido una sola vez. En caso de que exceda 30 días en faltas será sustituido por el magistrado que él designe, pero si excede de dicho término la designación del magistrado presidente interino la realizará el pleno del TSJE con base en la respectiva ley.
El Tribunal Superior de Justicia funcionará en pleno y en salas de conformidad con lo dispuesto en la ley. El pleno deberá integrarse por todos los magistrados del Poder Judicial y será presidido por el magistrado presidente.
Para ser magistrados los aspirantes deben ser veracruzanos; en caso de no serlo deben tener vecindad mínima de seis años, poseer al día del nombramiento el título de licenciado en Derecho expedido por la Institución Nacional de Educación Superior legalmente facultada para ello con una antigüedad mínima de diez años y contar con experiencia profesional en la judicatura o ejercicio de la profesión no menor de ese lapso.
