El Senado de la República aprobó la adición del artículo 137 bis a la Ley del Seguro Social para que cuando un pensionado desaparezca por más de un mes, sus beneficiarios tengan derecho a la pensión de éste en los términos del ramo de vida del seguro de invalidez y vida con carácter provisional.
Para ello bastará con que se compruebe el parentesco y la desaparición del pensionado, con la exhibición de la denuncia presentada ante el ministerio público correspondiente.
El dictamen aprobado, de las comisiones unidas de Seguridad Social y de Estudios Legislativos, determina que si el pensionado se presentase posteriormente, tendrá derecho a disfrutar de su pensión y a recibir las diferencias entre el importe original de la misma y aquél que hubiese sido entregado a sus beneficiarios.
Especifica que en ningún caso podrá entenderse una obligación del Instituto Mexicano del Seguro Social respecto de aquellos importes que hubieran sido pagados a los beneficiarios; pero cuando se compruebe el fallecimiento del pensionado, la transmisión será definitiva.
Las comisiones dictaminadoras reconocieron que en el país se vive una crisis humanitaria que no ha sido reconocida y asumida en su justa dimensión por el Estado mexicano, lo que limita el cumplimiento de sus obligaciones en materia de seguridad pública y justicia.
Lo anterior en detrimento de los familiares de personas desaparecidas, ya que quedan en una situación de incertidumbre y vulneración, señala el dictamen aprobado por el Pleno del Senado de la República.
De acuerdo con cifras oficiales del Registro Nacional de Personas Desaparecidas del Sistema Nacional de Seguridad Pública, hay un registro de 23 mil 689 personas no localizadas, desde 2007; de las cuales, 9 mil 672 han desaparecido durante el actual sexenio.
Los legisladores estiman que dicha cifra podría ser mayor, por los casos que no han sido denunciados por diversos motivos. Hasta marzo del 2015 se tiene un registro total de 25 mil 821 desaparecidos, de los cuales 59 por ciento son personas que se encuentran en edad productiva.
La tarea del Congreso de la Unión debe ser promover la aplicación de un marco jurídico sobre las personas desaparecidas, y la protección de los derechos de sus familiares, acorde a los tratados internacionales en esta materia, señalaron los senadores.
