Envía CNDH recomendación a Secretario de Marina

La Comisión Nacional de los Derechos Humanos (CNDH) emitió la Recomendación 62/2016, dirigida al Secretario de Marina, Vidal Francisco Soberón Sanz, por el cateo ilegal y violación a la integridad personal de una mujer, en la ciudad y puerto de Veracruz, atribuidos a efectivos de la Armada de México.

El 7 de agosto de 2012, entre las 03:00 y las 03:30 horas, la víctima dormía cuando elementos de la Secretaría de Marina (SEMAR) ingresaron a su hogar y los sacaron a golpes, los tiraron al suelo, les ordenaron callar, les vendaron los ojos y ataron las manos.

Mientras unos marinos registraron el lugar, otros los subieron a una camioneta y trasladaron a las instalaciones de la base naval ubicada en el kilómetro 13.5 de la carretera Xalapa-Veracruz, junto al aeropuerto internacional.

La víctima dijo que permaneció retenida de manera ilegal por 39 horas, tiempo en que fue torturada por los agentes navales que la cuestionaban sobre un grupo delictivo.

Agregó que a las 18:30 horas del 8 de agosto fue puesta a disposición del Ministerio Público Federal y obligada a firmar una declaración autoincriminatoria, acusada de formar parte de una organización criminal y diversos delitos, como delincuencia organizada, contra la salud y portación de arma de fuego y cartuchos de uso exclusivo de las fuerzas armadas.

El 17 de octubre presentó queja ante la Comisión Estatal de Derechos Humanos de Veracruz, que la remitió a la CNDH en razón de competencia el día 23 del mismo mes, formándose el expediente CNDH/2/2013/8619/Q. Tras su investigación, la CNDH acreditó que lo dicho por efectivos navales no se apegó a la realidad de los hechos, que no hubo orden de cateo ni flagrancia, que se transgredieron los derechos humanos a la inviolabilidad del domicilio, a la privacidad, a la legalidad y seguridad jurídica, además de que la víctima sufrió violación a su integridad personal en el tiempo que fue retenida ilegalmente por el personal de la SEMAR. (55) 56818125 y (55) 54907400 www.cndh.mx Por lo anterior, la CNDH recomienda al Secretario de Marina dar atención médica y psicológica a la víctima, para restablecer su salud física y mental, así como reparar el daño conforme a la Ley General de Víctimas; colaborar en la presentación y seguimiento de la denuncia de hechos que este Organismo Nacional presente ante la Procuraduría General de la República contra los agentes navales que intervinieron en los hechos.

Además, se impartan cursos de capacitación al personal de la SEMAR en materia de derechos humanos con enfoque de equidad de género, para que se trate con el debido respeto a las mujeres y se eliminen de inmediato detenciones, cateos e intromisiones domiciliarias ilegales.

Se solicita también que el personal médico y de sanidad naval adscrito a la SEMAR sea capacitado en la correcta aplicación de Manual para la investigación y documentación eficaces de la tortura y otros tratos o penas crueles, inhumanos o degradantes, para garantizar la imparcialidad y objetividad en las certificaciones de estado físico y mecánica de lesiones que realice y se remitan a la CNDH las constancias que acrediten su cumplimiento.
